Comment board terms and conditions of use
The Lil-lets UK Limited ("Lil-lets") comment board is provided by Lil-lets and is open to anyone who wishes to post their comments or views on the subject of the particular comment board hosted by Lil-lets on our website at www.lil-lets.co.uk (the "Comment Boards"). The Comment Boards are provided free of charge and may be viewed by the general public. Anyone using the internet may post messages on the Comment Boards.
In using the Comment Boards and posting comments you agree to be bound by these Terms and Conditions, as well as the Terms and Conditions of Use which relate to our website, www.lil-lets.co.uk.
By clicking on the "Post Comment" tab you are accepting these Terms. Please understand that if you do not wish to accept these Terms, you should not post messages or participate on the Comment Boards.
Any posts that contain personal information will not be allowed on the Comment Boards. However, we are not under an obligation to remove any personal details and if such comments or posts do get through our moderation they will be available for the general public to read – therefore, please do not post any personal details in your comments.
Please note that the information you insert in the "Name" box will appear on the Comment Board with your comment, however, you are free to assign yourself an appropriate username as an alternative.
1.1 Lil-lets monitor and review all posts which are submitted prior to them being allowed onto the Comment Boards.
1.2 Lil-lets are not responsible for any of the information which is submitted to be posted on the Comment Boards.
1.3 Any opinions expressed are the opinions of the users of the Comment Boards, and do not represent any advice or opinions of Lil-lets or any qualified medical professional. Any recommendation or other information within the Comment Boards is followed by you at your own risk and we do not warrant the accuracy of the information posted on it in any respect. Lil-lets is not responsible for and gives no endorsement of such material.
1.4 You may use the Comment Boards only to post comments, messages and material that are proper and appropriate to it and without limiting the generality of the foregoing you shall not do any of the following:
1.4.1 post messages, comments or links to other sites that:
(a) may be considered likely to provoke, offend, threaten, defame, stalk or harass others;
(b) contain libellous, abusive, racist, sexist, homophobic, ageist, sexually explicit, obscene or otherwise vulgar or in bad taste material;
(c) contain personal information or details, including, but not limited to, individuals names (including your own), contact details or addresses;
(d) contain a question to Lil-lets (please see the "Contact Us" section of these Terms);
(e) bully another user by deliberate, repeated and hostile behaviour intended to undermine, humiliate or belittle;
(f) advertise or offer to sell products or services for profit or solicit other users for commercial purposes;
(g) violate the legal rights (such as rights of privacy or intellectual property rights where applicable) of others; or
(h) break the law or encourage unlawful activity.
1.4.2 upload files or post anything containing malicious code, viruses, corrupted files or other similar harmful programs or material that may damage the operation of Lil-lets' or any other party's computer;
1.4.3 upload files or post anything which contains an active hypertext link to another website;
1.4.4 post any material which is copied to which you do not own the copyright; or
1.4.5 post messages referring to:
(a) health professionals by name;
(b) direct or indirect references to people or organisations that may identify a person; or
(c) any such posts that could damage the reputation of a living individual or organisation.
1.5 We will moderate all material that is submitted for posting on the Comment Boards. Due to this moderation process, comments may not appear immediately and may take up to 5 working days to appear on the Comment Boards. Please do not re-post comments which do not appear on the Comment Boards.
1.6 Even after material has been posted we may subsequently decide whether it is suitable to remain.
1.7 The moderators are not able to edit or amend any comment submitted for posting on the Comment Boards. If the moderators determine that a comment is not suitable for posting on the Comment Boards it will not be shown on the Comment Boards and shall be deleted. Comments will be posted as received by Lil-lets and will not be edited for spelling, grammar or any other reason.
1.8 Lil-lets reserves the right not to post (or to remove) any comments which are deemed damaging to the Lil-lets brand or which are believed to have been posted with the intent to harm.
1.9 If you discover any content on the Comment Boards which you consider breaches any of these Terms, or is otherwise unacceptable, you should notify Lil-lets immediately by contacting us using the details shown below in the ‘Contact us’ section of these Terms. Please note that we may not be able to remove or edit messages immediately.
1.10 Lil-lets reserves the right not to allow onto the Comment Boards, or to remove, any message at its sole discretion for any reason whatsoever. This reservation of right to delete messages does not mean that Lil-lets assumes any responsibility for the information contained on the Comment Boards. Any failure by Lil-lets to remove particular material does not constitute an endorsement or acceptance of it by Lil-lets.
1.11 You acknowledge that Lil-lets has the right to delete a comment without prior notice or reason and that our decision to remove or ban an individual from using the Comment Boards is final. Lil-lets is not obliged to enter into any correspondence regarding the moderation of content on the Comment Boards.
1.12 Lil-lets shall be entitled at any time to delete, remove or suspend the whole or any part of the Comment Boards or any information posted in it without notice and without incurring any liability.
1.13 You acknowledge, consent and agree that Lil-lets may access, preserve, and disclose your information and any content posted by you in order to: (a) comply with any legal process; (b) enforce these Terms; (c) respond to claims that any content posted on the Comment Boards violates the rights of third parties; (d) respond to your requests for customer service; or (e) protect the rights, property, or personal safety of Lil-lets, other users of this website and the public.
1.14 Subject to Paragraph 1.15 below and to the extent permitted by law, Lil-lets shall not be liable to you for any liability for any direct, indirect or consequential loss or damage incurred by you in connection with our Comment Boards or in connection with the use, inability to use the Comment Boards, and any information posted on them, including, without limitation any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of data; loss of goodwill or injury to reputation; and for any other loss or damage of any kind, however arising and whether caused by breach of contract, negligence or any other tort, (under statute or otherwise) even if foreseeable by us.
1.15 Nothing in these Terms affects, excludes or limits our liability for death or personal injury arising from our negligence.
1.16 We reserve the right to change these Terms at any time. Lil-lets will aim to make users aware of any significant changes. You should check the Terms periodically to ensure that you are aware of and complying with the current version. Use of the site and submitting comments following changes to these Terms shall indicate your acceptance of the new Terms.
1.17 If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
1.18 These Terms shall be governed by and interpreted in accordance with the laws of England and Wales and you and Lil-lets agree to submit to the exclusive jurisdiction of the English courts for the determination of disputes.
